He added that the <br /> City's annual counts show that trips on Stanley Boulevard and Del <br /> Valle Parkway have increased from 13,000 to 20,000 between 1988 and <br /> 1990 as a result of the completion of Bernal Avenue. <br /> <br /> Ms. Scribner inquired if a soundwall would be constructed by <br /> the alley behind the walnut trees. <br /> <br /> Mr. Swift replied that there would be a soundwall where the <br /> garages and the backyards are. <br /> <br /> There being no further testimony, Mr. Mercer declared the <br /> public hearing closed. <br /> <br /> Ms. Mohr inquired if the title on the units in which the City <br /> will retain an equity interest would be vulnerable to the owner's <br /> subjecting the property to liens, and if so, how that would affect <br /> the City's equity position. <br /> <br /> Mr. Roush replied that there would be a regulatory agreement <br /> that would provide that the City's interest would always be <br /> superior to everything other than a purchase money deed of trust. <br /> <br /> It was moved by Ms. Mohr, and seconded by Mr. Tarver, that <br /> Resolution No. 90-233 be adopted, based on a review of an initial <br /> environmental impact study done for this project and on a finding <br /> that no significant environmental impact would occur as outlined in <br /> the City's guidelines and on further finding that a negative <br /> declaration is appropriate in connection with PUD-90-14, the <br /> application of Joseph W. Callahan, Jr. for planned unit development <br /> rezoning to PUD-HDR and development plan approval to allow the <br /> construction of 88 single-family detached zero lot-line units, 46 <br /> for rent in-law units and 24 attached townhouse units on an <br /> approximately 12.76 acre site located at 3801, 3963, and 3967 <br /> Stanley Boulevard, the area generally bounded by Stanley Boulevard <br /> on the south and east, the Union Pacific Railroad on the north, and <br /> the Country Roads Condominiums on the west. <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Mohr, Scribner, Tarver and Mayor Mercer <br /> NOES: None <br /> ABSENT: None <br /> ABSTAIN: Councilmember Butler <br /> <br /> Mr. Tarver stated that the project was an excellent planned <br /> unit development and commended Mr. Callahan for working with staff <br /> to provide the kind of housing that Pleasanton needs. <br /> <br /> - 20 - <br /> 12-11-90 <br /> <br /> <br />
