108 <br /> <br /> Mr. Mercer declared the public hearing open on the <br /> application. <br /> <br /> Mr. Peter Shutts, architect, representing Jay and Kyoung Ku, <br /> developers and owners of the proposed senior care facility, <br /> explained that an intermediate care facility is designed to handle <br /> and address the basic needs of senior citizens who do not need <br /> full-time nursing care. The facility offers programs and <br /> opportunities to assist the residents in terms of cooking meals, <br /> grooming, personal hygiene, and transportation. He stated that the <br /> project's design concept would provide a wholesome environment for <br /> seniors, including interior courts. Although the original plan <br /> (Alternative 1) meets the parking requirement ratio of % car space <br /> per room, a revised plan (Alternative 2) mitigates some of the <br /> concerns of the neighbors regarding the driveway location at the <br /> southwest corner of the site by adding more parking spaces and <br /> consolidating them at the eastern portion of the site. This would <br /> limit the impact of the driveways to the intersection on Kolln <br /> Avenue, with a potential maximum of 90 trips a week, taking up less <br /> than half of parking lots provided on southwest corner of the site <br /> by the entrance. Additional parking is provided on Mohr Avenue for <br /> evening or holiday visits. He added that to minimize the number of <br /> trips on the north side of Mohr Avenue, an agreement was made with <br /> the owner of the next-door office building to have an access <br /> easement through his driveway to a service court located on the ' <br /> northwest corner of the site. The proposal includes widening Mohr <br /> Avenue by 16 feet to the north and the installing curbs, gutters <br /> and a sidewalk setback of five feet. Another 1.5 feet of pavement <br /> with curb and gutter will be added across the street to create a <br /> full 40-foot width, thereby increasing the safety of vehicular <br /> traffic along the eastern and western directions of Mohr Avenue. <br /> The number of residents will be limited to 90, occupying 50 private <br /> and 20 semi-private rooms. He requested Council to consider both <br /> alternatives, preferably approving Alternative 1. <br /> <br /> Mr. Brandes inquired how the City would legally enforce the <br /> number of occupants in the facility. <br /> <br /> Mr. Swift replied that staff has included a condition that the <br /> operation would be limited to 90 residents, which would be enforced <br /> like any other PUD condition or use permit condition. <br /> <br /> Mr. Roush commented that this would pose no legal problem <br /> because if a consistent problem with the number of occupants <br /> arises, the City could seek to obtain an injunction to enjoin the <br /> use of the premises for no more than a specific number of persons. <br /> <br /> - 10 - <br /> 11-20-90 <br /> <br /> <br />
