PUBLIC HEARINGS <br /> Item 6a <br /> AP-90-8, City of Pleasanton, A~peal of a Decision of the Design <br /> Review BoardWhich Approved Case Z-89-557, the Application of Manoj <br /> Dave for Design Review Approval for an Approximately 10,100 Square <br /> Foot Single-Family Residence and Landscaping Plan Located at 9900 <br /> Lon~view Lane (Upper LonqvieW) <br /> <br /> Mr. Swift presented his report (SR 90:264) r~garding the <br /> matter. <br /> <br /> Mr. Mercer declared the public hearing open on the appeal. <br /> <br /> Mr. Geoff Etnire, 6140 Stoneridge Mall Road, representing the <br /> applicant, Mr. Manoj Dave, stated that the house was approved by <br /> the Council in January with a condition that it achieve the <br /> screening effect of the computer-generated photograph. He added <br /> that the Design Review Board had given two alternatives to achieve <br /> this: (1) Use trees that are indigenous to California but not <br /> indigenous to the hillside, which would achieve the screening <br /> effect in three to five years; or (2) Use trees that are indigenous <br /> to the hillside, which would achieve the screening effect in five <br /> to seven years. He commented that the application was filed in <br /> August 1989 and that there was no feedback against the house during <br /> the public hearings prior to the approval of the application in <br /> January. He pointed out that the issue at this time is the <br /> achievement of the screening condition and urged Council to deny <br /> the appeal since the Design Review Board has agreed that that <br /> condition would be met. <br /> <br /> Mr. Kevin McDonnell, 9944 Longview Lane, President of Longview <br /> Homeowners' Association, indicated that the Homeowners' Association <br /> does not approve of the house because it does not comply with the <br /> Association's CC&Rs, which provide that custom homes on the hills <br /> should blend in with the landscape and not be an eyesore from the <br /> valley. He added further that the CC&Rs allow only two structures <br /> of two stories each on the land, and the plan for this house has <br /> more than two structures, with an apparent height of five stories. <br /> He stated that the house is too big for the lot, which is one of <br /> the most visible on the hill, and requested Council to uphold the <br /> appeal. <br /> <br /> Mr. Mercer inquired what impact the disapproval of the <br /> Homeowners' Association would have on the project. <br /> <br /> Mr. Roush replied that if an applicant were dissatisfied with <br /> the decision by the Homeowners' Association but had City approval, <br /> he would have the right either to proceed and let the Homeowners' <br /> Association take him to court, or the applicant could seek <br /> <br /> 10-2-90 <br /> - 8 - <br /> <br /> <br />
