37

declaratory relief so that he could proceed with the construction
of the house. He clarified that the Council's action is altogether
a separate matter from the action of the Homeowners' Association.

Mr. Brandes asked Mr. McDonnell if information on the
screening of the house was made available to the Homeowners'
Association and if any member of the Association attended the
hearings at the Design Review Board meeting.

Mr. McDonnell replied that the Association was shown a copy of
the computer-generated photograph and that all other information it
had came from the Staff Reports. He added that he did not attend
the Design Review Board hearings and was not aware if any of the
members did; however, he had read all public records on the matter.

Mr. Jim Herd, 9904 Longview Lane and ten year resident of
Pleasanton, stated that he has studied the project quite
extensively, although he has not received the complete materials on
the project that he had requested from the owners. He indicated
that the five-level structure is too massive, with the complete
front elevation facing the valley being about 200 feet long and 56
feet tall. He mentioned that although the plan indicates that the
house would have four bedrooms, it would actually have nine
bedrooms and twelve bathrooms. He pointed out that the lot is too
exposed for the building and that landscaping will not achieve the
screening of the property. He added that he was personally
concerned about some issues regarding the species of trees, road
access, and the elevation of his property in relation to the Dave
property as well as an easement on the Dave property for his
property.

Mr. Harold Ceizler, 9911 Longview Lane, member of the Longview
Homeowners' Association, stated that the applicant should be
subject to the same CC&Rs as the rest of the neighbors. He added
that the house would have a frontal view of about 15,000 square
feet which would be more visible from the valley than any other
house on the hill.

Ms. DeeDee Ranahan, 9988 Longview Lane, member of the Longview
Homeowners' Association, stated that she is one of the seven
residents in the Association, which also includes two unoccupied
lots, and one house under construction. She concurred with the
statements of the other Association members that had spoken
earlier.

Mr. Etnire indicated that the house complies with all the
provisions of the zoning ordinance of the City, including the
special regulations applying to hillside homes. He stated that the
Planning Department has a set of the complete plans for the house,
which is available to the public. He added that the conclusion

10-2 -90
- 9 -
