483 <br /> <br /> Mr. Butler stated that the applicant tried to address the <br />issues raised by staff but did not solve the problems and agreed <br />with Mr. Tarver that the project had one too many lots. He added <br />that although many houses in the area are closer than 150 feet to <br />the road, the FRCODS was just adopted and that he would like to see <br />it applied in this case. <br /> <br /> Mr. Mercer indicated that safety is an important issue and <br />added that the FRCODS was adopted to preserve Foothill Road and to <br />correct some mistakes made in the past. He stated that he could <br />not support the project. <br /> <br /> It was moved by Mr. Tarver, and seconded by Mr. Butler, that <br />Resolution No. 90-172 be adopted, denying AP-90-12, PUD-89-12, <br />thereby upholding the decision of the Planning Commission which <br />denied the application of Douglas Harvey and Robert Martin for <br />planned unit development rezoning and development plan approval to <br />rezone the property from Agricultural to PUD-LDR and to develop a <br />five-lot, single-family residential development to be located on an <br />approximately 3.8 acre site located at 2818 Foothill Road. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Mohr, Tarver and Mayor Mercer <br />NOES: None <br />ABSENT: Councilmember Brandes <br />ABSTAIN: None <br /> <br /> Item 6b <br />PUD-90-7, Application of Jav and KVounq Ku for Planned Unit <br />Development Rezoninq and Development Plan Approval to Construct a <br />Two-Story# Approximately 48,000 Sq.
