481 <br /> <br /> Mr. Mercer opened the continued public hearing from the <br />September 4, 1990 City Council Meeting. <br /> <br /> Mr. Doug Harvey, 5586 Sonoma Drive, stated that at the last <br />Council meeting, he discussed the history of the project as well as <br />the issues on amenities, road circulation and the 150-foot setback <br />requirement and that he presented a revised drawing with a <br />different setback. He reiterated that the none of the existing <br />houses around the project meet the 150-foot setback requirement of <br />the Foothill Road Corridor Overlay District Study (FRCODS) and <br />requested that the setback requirements be modified. <br /> <br /> Referring to Condition No. 7, he indicated that he was opposed <br />to having a homeowners association, which is for larger projects <br />and requires a budget, Articles of Incorporation, By-Laws and <br />Restrictions. Instead, he proposed a joint maintenance agreement <br />for the private roadway and a deed restriction to divide the <br />landscape maintenance for the scenic easement area. <br /> <br /> With respect to Condition No. 12 which requires the extension <br />of the underground public utilities to the westerly end of the <br />property, he stated that the frontage of all the lots would be <br />improved with the widening of the roads in front of the Vassallo <br />and Cerruti houses and the installation of new utility lines for <br />the existing houses. <br /> <br /> Mr. Mercer inquired what the position of the Fire Department <br />was regarding the 20-foot road. <br /> <br /> Mr. Swift replied that a 20-foot street is sub-standard, based <br />on the Fire Department and City standards. He added that the Fire <br />Department prefers streets serving more than a single lot to be <br />wider than 20 feet. <br /> <br /> Mr. George Withers, Pleasanton Fire Chief, stated that fire <br />trucks would not be able to turn around in the middle of the <br />20-foot roadway. The trucks would have to either go to the <br />cul-de-sac or make a triple turn on the road and back into the <br />driveways, which could result in cracking the driveways and <br />potential lawsuits for damages against the City. <br /> <br /> Mr. Mercer asked Mr. Harvey if a wider street were possible <br />for his project. <br /> <br /> Mr. Harvey replied that he had increased the setback to <br />75 feet, picking up an additional 22 feet, eight feet of which come <br />from the street change from 28 feet to 20 feet. He stated that <br />widening the road to 28 feet would bring the road closer to <br />Foothill Road by eight feet.
