She disagreed <br /> with the finding that eminent domain has led to the infeasibility <br /> of agricultural use and that the cancellation is consistent with <br /> the purposes of the Act, as well as with the subfinding that <br /> adjoining lands would not be removed from agricultural use as a <br /> result of the cancellation. With regard to the General Plan <br /> conformity, she indicated that the project is marginal in its <br /> conformance to many of the General Plan policies cited in the EIR, <br /> such as the project's land use footprint and the use of density <br /> transfers within the project site. She proposed that creating a <br /> public park in the area would be consistent with the General Plan <br /> goal of providing eight acres of public recreation space per 1,000 <br /> population. Finally, in connection with the EIR, she pointed out <br /> that future studies proposed as mitigations are not proper under <br /> CEQA and that the developer's response to the public's desire for <br /> a more detailed evaluation that enough information has been <br /> provided for the City's decision makers is unacceptable. <br /> <br /> Mr. Art Tenbrink, 4265 Mirador Drive, a Pleasanton resident <br /> for 16 years, expressed concern about the decreasing viewshed and <br /> the increasing traffic patterns in the areas surrounding the <br /> development. He indicated that 100 residents have signed a <br /> petition to keep Mirador Drive and Independence Drive from becoming <br /> through-ways and to require the Bonde development to feed traffic <br /> on Bernal Avenue extension, away from the existing neighborhoods, <br /> as was intended by the Bernal Avenue/Valley Avenue peripheral <br /> traffic circle. <br /> <br /> Mr. Richard Chagnon, 4120 Casterson in Kottinger Ranch, a <br /> resident of Pleasanton for 23 years, stated that Kottinger Ranch is <br /> an eyesore and that the developer has not complied with some of the <br /> conditions of approval for the development. <br /> <br /> Mr. Mercer informed Mr. Chagnon to contact the City Manager in <br /> this regard. <br /> <br /> Ms. Karen Kearl, 4524 Mirador Drive, a resident of Pleasanton <br /> for 23 years, questioned the inclusion in the Staff Report of a <br /> petition that was over a year old. She stated that because of <br /> decreasing school bus service, more children are walking on Mirador <br /> Drive to Valley View Elementary School. She added that discussing <br /> the development before the cancellation of the Williamson Act <br /> contract is inappropriate and that developing Bonde Ranch at this <br /> time is not feasible, given the stock of houses on Kottinger Ranch. <br /> <br /> Mr. Gerald Severin, 4513 Mirador Drive, a Pleasanton resident <br /> for 24 years, requested Council to deny the cancellation of the <br /> Williamson Act contract and the development for the best interest <br /> of the public. He stated that the extension of Bernal Avenue cut <br /> <br /> - 16 - <br /> 4-2-91 <br /> <br /> <br />
