116 <br /> <br /> Item 6d <br /> Case PUD-90-18, Shapell Industries of Northern California, <br /> Application for Rezoning to the PUD (Planned Unit Development) - <br /> MDR (Medium Density Residential), LDR (Low Density Residential), <br /> and RDR (Rural Density Residential) Districts, for PUD Development <br /> Plan Approval, and for Land Conservation Contract (Williamson Act) <br /> Cancellation to Allow the Construction of 113 New Single-Family <br /> Residential Units (in Addition tot he ExisitinfBonde Residence) on <br /> an Approximately 104 Acre Site Located on the Northerly and <br /> Southerly Sides of Bernal Avenue and Approximately 2,250 Feet <br /> Southeasterly of Sunol Boulevard and to Consider Certification of <br /> the Environmental Impact Report (SR 91:121) <br /> <br /> Mr. Mercer declared the public hearing open on the <br /> application. <br /> <br /> Mr. Woody Pereira, Shapell Industries of Northern California, <br /> representing the applicant, stated that development on the Bonde <br /> Ranch began after the owner, Mrs. Roselma Bonde, realized that she <br /> could no longer continue a viable agricultural operation. He noted <br /> that the philosophy of the Bonde Ranch development is to retain as <br /> much open space as possible and to be consistent with the General <br /> Plan. He indicated that the cluster of new units would mostly be <br /> adjacent to existing and planned residential developments and that <br /> the major land forms would remain basically unchanged, with grading <br /> being done only for the residential lots and the streets. He <br /> stated that the project staff has been working with the Design <br /> Review Board for the past year and that suggestions from City Staff <br /> and the neighbors, as well as Environmental Impact Report (EIR) <br /> mitigations, have been incorporated in the plan. He indicated that <br /> Mr. Chris Truebridge of Shapell Industries, Mr. Jeff Holmwood of <br /> Bissell & Karn, Engineers, Mr. Frank Berlogar of Berlogar <br /> Geotechnical Consultants, and Mr. Robert Willett, attorney for Mrs. <br /> Bonde, were present to answer any questions on the project. <br /> <br /> Mr. Duke Bonde, Jr., 706 Neal Street, stated that he grew up <br /> on the Bonde Ranch when there were no houses around and has lived <br /> in the area for 30 years. He indicated that new developments have <br /> changed the ranch land, including the extension of Bernal Avenue <br /> and Kottinger Ranch, and that he welcomes all the new neighbors in <br /> the area. <br /> <br /> Mr. Robert Willett, 2710 Gateway Oaks Drive in Sacramento, <br /> attorney representing Mrs. Bonde, stated that as indicated in the <br /> Staff Report, there is substantial evidence that all the findings <br /> can be made for the cancellation of the Williamson Act contract. <br /> He pointed out that the property has been so altered that the <br /> purpose for which the Contract was initiated cannot be continued <br /> and that the cancellation is for the public interest and is <br /> <br /> - 10 - <br /> 4-2-91 <br /> <br /> <br />
