63 <br /> <br /> Ms. Cathy Rice, 590 Abbie Street, owner of the industrial <br />property alongside a portion of the property, reiterated her <br />request that a disclosure statement be given to potential <br />homebuyers that her business operates a swing shift until midnight <br />and that the CC&Rs indicate that parking for the project is not <br />available within the industrial property. <br /> <br /> Mr. Swift stated that the two issues were included in the <br />draft conditions of approval. <br /> <br /> There being no further testimony, Mr. Mercer declared the <br />public hearing closed. <br /> <br /> It was moved by Ms. Mohr, and seconded by Mr. Tarver, that <br />Resolution No. 91-31 be adopted, based on a review of an initial <br />environmental impact study done for this project and on a finding <br />that no significant environmental impact would occur as outlined in <br />the City's guidelines and on further finding that a negative <br />declaration is appropriate in connection with PUD-90-20, the <br />application of Joseph W. Callahan, Jr., to rezone approximately <br />4.26 acres of land from the General Industrial Zoning District to <br />the PUD- High DensityResidential District and for PUDdevelopment <br />plan approval to provide for the construction of 21 single-family <br />detached dwelling units and 15 townhomes to be located at the <br />southwest corner of the RheemDrive/Oakland Avenue intersection, as <br />set forth in the Staff Report. <br />The roll call vote was as follows: <br />AYES: Councilmembers Mohr, Scribner, Tarver and Mayor Mercer <br />NOES: None <br />ABSENT: Councilmember Butler <br />ABSTAIN: None <br /> <br /> Ms. Scribner requested that Condition No. 5b be clarified by <br />indicating that residents' cars may not be parked within the guest <br />parking spaces of the townhome development. <br /> <br /> Mr. Tarver commented that this is the second project that Mr. <br />Callahan has brought forward to provide affordable housing to the <br />community. He indicated that he would like to see more development <br />projects. of this kind, possibly with smaller units to accommodate <br />a greater number. <br /> <br /> It was moved by Ms. Mohr, and seconded by Mr. Tarver, that <br />Ordinance No. 1501 be introduced, to be read by title only and <br />waiving further reading thereof, approving PUD-90-20, the <br />application of Joseph W. Callahan, Jr., to rezone approximately <br />4.26 acres of land from the General Industrial Zoning District to <br />the PUD - High Density Residential District and for PUDdevelopment <br /> <br /> - 13 - <br /> 3-5-91 <br /> <br /> <br />
