214

6. PUBLIC HEARINGS
Item 6a
PUD-89-6-3M, Spieker Partners, Application for a Ma~or Modification
of the Approved Planned Unit Development for Rose Pavilion
(Phase III), Located at the Northwest Comer of Santa Rita Road and
Rosewood Drive

This item was continued to the June 18, 1991 City Council
Meeting.

Item 6b
PUD-90-21, Roy Thompson, Application for PUD Rezoninq and
Development Plan Approval for a Three-Lot Sinqle-FamilyCustom Home
Development on a 0.98-Acre Site Located at 6240 Sunol Boulevard
(SR 91:214)

Consider Adoption of a Neqative Declaration

Mr. Mercer declared the public hearing open on the
application.

Mr. Roy Thompson, 1347 Vintner Way, requested that Council
reconsider Condition No. 11 of the Conditions of Approval regarding
the cul-de-sac, which was recommended by the Planning Commission
for use by the public for turnaround purposes. He stated that the
house was designed to replace a house that was burned and which had
a private circle drive. He indicated that there is sufficient room
for public turnaround on the driveway by Lots 1 and 3, and that he
would like to keep the cul-de-sac a private street, as it was
designed to be.

There being no further testimony, Mr. Mercer declared the
public hearing closed.

Ms. Mohr stated that she found the request consistent with the
neighborhood.

It was moved by Ms. Mohr, and seconded by Mr. Tarver, that
Resolution No. 91-88 be adopted, based on a review of an initial
environmental impact study done for this project and on a finding
that no significant environmental impact would occur as outlined in
the City's guidelines and on further finding that a negative
declaration is appropriate in connection with PUD-90-21, the
application of Roy Thompson for PUD rezoning and development plan
approval for a three-lot single-family custom home development on
a 0.98-acre site located at 6240 Sunol Boulevard.

- 4 -
6-4-91
