195 <br /> <br /> Mr. Mercer requested Mr. Pereira that the oak trees to be <br />removed from the site be cut into firewood length and delivered to <br />the Senior housing projects at Kottinger Place and Ridgeview <br />Commons for next winter. <br /> <br /> Mr. Pereira said yes. <br /> <br /> Mr. Butler stated that he would like to make sure that the <br />conditions relating to the time of construction and control of dust <br />and noise are adhered to. <br /> <br /> Mr. Swift stated that the noise condition was included because <br />the Noise Ordinance allows what most of the neighbors are opposed <br />to. The condition would allow construction on week-ends, during <br />certain hours, as long as the activities do not involve heavy <br />earth-moving equipment and road building. <br /> <br /> Mr. Pereira indicated that he did not have any problem with <br />the conditions, as written. <br /> <br /> Mr. Tarver stated that he could not support the project, but <br />commended Shapell Industries for a good job at addressing the <br />neighbors' concerns. <br /> <br /> It was moved by Mr. Butler, and seconded by Ms. Mohr, that <br />Ordinance No. 1509 be introduced, to be read by title only and <br />waiving further reading thereof, approving Case PUD-90-18, the <br />application of Shapell Industries of Northern California/ <br />Ms. Roselma Bonde for rezoning to the PUD (Planned Unit <br />Development) - MDR (Medium Density Residential), LDR (Low Density <br />Residential), and RDR (Rural Density Residential) Districts and for <br />PUD development plan approval to allow the construction of 102 new <br />single-family residential units (in addition to the existing Bonde <br />Residence) on an approximately 104-acre site located on the <br />northerly and southerly sides of Bernal Avenue, approximately 2,250 <br />feet southeasterly of Sunol Boulevard, subject to the Conditions of <br />Approval as set forth in the Supplemental Staff Report and as <br />amended by earlier Council action. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Mohr, and Mayor Mercer <br />NOES: Councilmembers Scribner and Tarver <br />ABSENT: None <br />ABSTAIN: None <br /> <br /> - 19 - <br /> 5-21-91 <br /> <br /> <br />
