However, the homeowners association would <br /> control the land if the City only had an easement. <br /> <br /> Mr. Tarver stated that his preference is to allow public <br /> access with the City assuming liability but not maintenance <br /> responsibility. <br /> <br /> Mr. Mercer indicated that he would like the Development <br /> Agreement to be as comprehensive as possible for the public to <br /> consider. <br /> <br /> Mr. Strickler requested that the details of the Letter of <br /> Understanding between the developer and the Ventana Hills Steering <br /> Committee be included in the Development Agreement. <br /> <br /> Mr. Mercer said yes and requested Mr. Strickler and the <br /> Committee members to participate in the deliberations on the <br /> Development Agreement in order that everybody has a firm <br /> understanding of what is agreed upon. <br /> <br /> It was moved by Mr. Mercer, and seconded by Mr. Butler, to <br /> include the Letter of Understanding, dated May 1, 1991, and the <br /> documents from other homeowners association in the Development <br /> Agreement. <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Butler, Mohr, Scribner, Tarver and Mayor <br /> Mercer <br /> NOES: None <br /> ABSENT: None <br /> ABSTAIN: None <br /> <br /> It was then moved by Mr. Mercer, and seconded by Mr. Butler, <br /> to direct Shapell Industries to meet with City Staff to work out <br /> view easements for Lot 46 to Lot 50. <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Butler, Mohr, Scribner, Tarver and Mayor <br /> Mercer <br /> NOES: None <br /> ABSENT: None <br /> ABSTAIN: None <br /> <br /> - 18 - <br /> 5-21-91 <br /> <br /> <br />
