153 <br /> <br /> It was moved by Ms. Mohr, and seconded by Mr. Butler, that <br />Resolution No. 91-208 be adopted, approving and adopting the <br />policies governing the Pleasanton Second Mortgage Loan Program, <br />subject to a further condition that should subsequent financing be <br />obtained, the City's second mortgage is to be paid off. <br /> <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Mohr, Scribner, Tarver and Mayor <br /> Mercer <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br />Item 12e <br />Review of Kaiser Sand and Gravel County Surface Mininq Permit <br />Application - SMP-31. (SR91:509) <br /> <br /> Mr. Larry Appleton, representing Kaiser Sand and Gravel, <br />stated that he submitted this application to the County of Alameda <br />22 months ago. It took two years and $150,000 to get a <br />certifiable, legal and adequate EIR. At the County hearing there <br />was no opposition and the Planning Commission agreed to proceed on <br />the permit. The issues that the Planning staff are concerned with <br />are the future development of the site and the First Street truck <br />traffic. Mr. Appleton referred to letters given to the Council by <br />its environmental consultant, its attorney and the County Planning <br />Department which indicate that there is no basis for the <br />discrepancies claimed to the EIR. 'He also referred to the staff <br />report regarding giving the Council two options, either review the <br />EIR or write a letter claiming that the EIR is inadequate to be <br />signed by the Mayor. He requested the Council recommend <br />certification of the EIR. <br /> <br /> Mr. Roush stated that the proposed draft letter indicates that <br />the City does not intend to enforce our Ordinance. Council can <br />still comment on the mitigation measures on First Street without <br />causing all truck traffic to cease. There is also an issue about <br />the operational aspect of the processing plan completely separate <br />from the gravel trucks routes. <br /> <br /> Ms. Mohr indicated that other than the "chain of lakes", <br />there was no use expected for these lands. The expectation for <br />these properties was that it would be permanent open space between <br />Livermore and Pleasanton. The City has nothing in its General Plan <br />to accommodate the impact to the City. Ms. Mohr agreed that the <br />City has its resolution through the courts. She was concerned, <br />however with the level of development that would be approved. <br /> <br /> Mr. Tarver stated that the letter speaks to the truck traffic. <br /> Ms. Mohr indicated that the truck traffic was not the specific <br /> <br />12/10/91 27 <br /> <br /> <br />
