His <br /> residence is just below the applicant's. At the Planning <br /> Commission Meeting he represented himself as the President of the <br /> Homeowners Association. Since then, there has been an election <br /> with a new President, however, he has not yet taken over the <br /> duties. Mr. Sugasawara is here speaking on behalf of the Board of <br /> Directors. The concern is mainly with the detached nature of the <br /> structure. They are pleased that the applicant has decided against <br /> the garage unit but are still concerned over having a detached <br /> secondary unit which may set a precedent that they don't like. <br /> Eventually when the applicant's mother-in-law is no longer in <br /> residence the concern is that this unit may become a rental unit. <br /> The understanding is that the second unit would have a separate <br /> address which instills a lot of fear in the surrounding homeowners <br /> for the negative impacts this detached secondary unit would have on <br /> the surrounding properties. <br /> <br /> There being no further testimony, Mr. Mercer declared the <br /> public hearing closed. <br /> <br /> Mr. Butler asked Mr. Swift if he felt that if this plan were <br /> to go back to the Planning Department for further review would <br /> there be an opportunity for working out this PUD in a way that <br /> would be acceptable to both parties. <br /> <br /> Mr. Swift replied that he would like to think so. The staff <br /> has been leaning towards having the secondary unit attached to the <br /> building so that it would look like one structure. <br /> <br /> Mayor Mercer felt that attaching the unit is the right thing <br /> to do. Ms. Scribner also agreed with that. Mr. Butler felt that <br /> it is very possible to approve the structure especially if there <br /> isn't a third structure on the property, as long as it's designed <br /> and integrated into the building. <br /> <br /> It was moved by Mr. Tarvet, and seconded by Mr. Butler, that <br /> the appeal for a Conditional Use Permit for a secondary unit <br /> located at 1 Roman Eagle Way be denied without prejudice. <br /> The roll call vote was as follows: ~ <br /> AYES: Councilmembers Butler, Scribner, Tarver and Mayor Mercer <br /> NOES: None <br /> ABSENT: Mohr <br /> ABSTAIN: None <br /> <br /> 10-01-91 12 <br /> <br /> <br />
