57

The roll call vote was as follows:
AYES: Councilmembers Butler, Scribner, Tarver and Mayor Mercer
NOES: None
ABSENT: Mohr
ABSTAIN: None

It was moved by Mr. Butler, and seconded by Ms. Scribner, that
Ordinance No. 1522 be introduced, to be read by title only and
waiving further reading thereof, approving PUD-91-8
Russell K, Schaeffer, application to rezone a 1.4± acre parcel
located at 5059 Foothill Road from the "A" (Agricultural) to the
PUD (Planned Unit Development) - Medium Density Residential
District and for development plan approval for a five lot single-
family residential development.
The roll cal~ vote was as follows:
AYES: Councilmembers Butler, Scribner, Tarver and Mayor Mercer
NOES: None
ABSENT: Mohr
ABSTAIN: None

Item 6d
AP-91-07/UP-91-20, James Griffen; ADDeal Of a Plannina COmmiSSion
denial without DreiudiCe of a COnditional Use Permit for a
secondary unSt to be located at 1 Roman Eaale Way. (SR 91:411)

Mr. Mercer declared the public hearing open on the
application.

Mr. James Griffen, 1 Roman Eagle Court, Pleasanton, wished to
clarify some points on the staff report. The report speaks of a
carport on this plan, however, it was the previous plan that had
the carport. The plan under consideration does not have one. On
the project description, the plan shows two buildings, however, the
future R.V. storage is not a part of this application either. This
application is for a "granny flat" only. There is also a comment
regarding interference with existing views, yet the views that
would be interfered with are not primary views of any of the
residences. It was suggested by the Planning Staff that the
secondary dwelling unit be put in the basement of the existing
unit. The existing basement does not have a full eight foot
ceiling. It is not the intent to make a multiple housing unit out
of the residence but rather to construct two separate residences.

Mr. Butler wanted assurance that all Mr. Griffen wanted
Council to deal with is the conditional use permit for a secondary
unit dwelling that is 15 feet high and one story only.

Mr. Tarver asked Staff if this application should go through
the process again since it appears that what is in the staff report
is not actually what Mr. Griffen is stating he wants.

10-01-91 11
