35 <br /> <br /> Ms. Mohr asked if there was a possibility that the tank might <br />be allowed to stay if it met the proper standards. <br /> <br /> Mr. Swift replied that it was an above ground tank which means <br />that it cannot remain, and that it will be removed within 120 days. <br /> <br /> Mr. Cordtz wanted assurance that the City would be in no <br />danger from hazardous chemical spills or contamination due to <br />storage on the property. <br /> <br /> Mr. Swift explained that those concerns mentioned fall under <br />the Hazardous Waste Ordinance which is both county and state <br />controlled and falls under the auspices of our Fire Department, <br />which is why it was referred to the Hazardous Waste Expert in the <br />Fire Department. The City's hazardous materials storage ordinance <br />applies in all zoning districts. The Fire Department has no <br />problems with the storage as long as the hazardous materials are <br />stored in accordance with the City's ordinances. <br /> <br /> There being no further testimony, Mr. Mercer declared the <br />public hearing closed. <br /> <br /> Ms. Mohr inquired about the SP right-of-way and whether the <br />proposed use would be incompatible should the right-of-way be used <br />for a light rail system or an iron-horse trail. <br /> <br /> Mr. Swift replied that there would not be any incompatibility <br />to any of those uses mentioned other than the fact that it might <br />not be the most aesthetic use for a pedestrian trail through that <br />area. The SP Corridor is elevated in relation to the site. It <br />should not be any more incompatible than the rear of any other <br />commercial buildings that abut the SP Corridor through downtown <br />Pleasanton. <br /> <br /> It was moved by Ms. Mohr, and seconded by Mr. Tarver, that <br />Resolution No. 91-160 be adopted, based on a review of an initial <br />environmental impact study done for this project and on a finding <br />that no significant environmental impact would occur as outlined in <br />the City's guidelines and on further finding that a negative <br />declaration is appropriate in connection with the application for <br />rezoning and development plan approval as filed under Case <br />PUD-91-4. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Mohr, Scribner Tarver and Mayor <br /> Mercer <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br />9-17-91 5 <br /> <br /> <br />
