PUBLIC HEARINGS
Item 6a
PUD-91-4, Dunkley/Mix/Ransen; Application for rezoninq to the PUD
(Planned Unit Development) - Service Commercial and Office District
and development plan approval to allow a combination of commercial
and office uses on a developed and vacant site totaling
approximately 2.22 acres located at 63 and 73 Ray street. Zoning
for the property is C-S (Commercial-Service) District. (SR 91:379)

Mr. Mercer declared the public hearing open on the
application.

Mr. Greg Mix, 239 Main Street, owner of the vacant lot and
representative of the owner of the building, stated that this is a
relatively small but significant change in zoning. It would allow
a few office spaces that already exist in the office building to be
rented to a very restricted group of users who will be very low
traffic users. He indicated that he has talked to the neighbors
and addressed their concerns and the applicants agree with all the
conditions of approval in the staff report.

Mr Robert Cordtz, 262 W. Angela, had some concerns regarding
the gas tank buried in the property without permit._ He wanted to
know how that gas tank got there without a permit?

Mr. Mercer assumed that the situation has been turned over to
the Hazardous Materials Specialist in the Fire Department but
referred the questions to Brian Swift of the Planning Department.

Mr. Swift indicated that he did not have the answers to all
the questions posed, but that the situation is being reviewed by
the Fire Department and the entire installation must be brought up
to the requirements of the State and City Ordinances with respect
to that tank.

9-17-91 4
