Zoning for the property is PUD (Planned Unit <br />Development) - Low Density Residential District. <br /> <br />Also consider adoption of a Negative Declaration. <br /> <br /> Mr. Mercer declared the public hearing open on the <br />application. <br /> <br /> Fred Hempy, 5000 Foothill Road, stated that two and half years <br />ago he came before Council requesting approval for a four-lot <br />subdivision which was originally a five-lot subdivision. He had <br />worked with staff on reducing the five-lot down to a four because <br />of the concern of the setbacks of the two homes that were directly <br />on Foothill Road. A four-lot subdivision was created at that time <br />including an existing home in an area that was designated as <br />temporary open space.
