62 <br /> <br /> Jack Lavey, 4183 First Street, spoke in opposition to the <br /> appeal. He stated that the heavy traffic on First Street occurred <br /> only in the early morning. <br /> <br /> Brent Wilcox, 3988 Stanley Boulevard, was opposed to the <br /> appeal and felt this project was appropriate for that site. <br /> <br /> Keith Warden, 2931 Liberty Drive, spoke in favor of the <br /> application, felt that the traffic would not be a problem and asked <br /> Council to approve this project. <br /> <br /> Bob Weaver, 5493 Dudley Court, supported this application. He <br /> indicated that most people who attend funerals do not drive alone. <br /> Therefore, the number of parking spaces that the mortuary provided <br /> should be sufficient. <br /> <br /> There being no further testimony, Mr. Mercer declared the <br /> public hearing closed. <br /> <br /> Ms. Mohr asked staff if there would be any impact to this <br /> project if the Southern Pacific right-of-way was converted into a <br /> four lane street to relieve First Street. <br /> <br /> Mr. Swift replied "no" because the building adjacent to the <br /> site, and other properties nearby, were built on the property line <br /> where there is a 100 foot right-of-way which could be used to build <br /> that kind of street. <br /> <br /> Mr. Butler added it was difficult to focus on the issue <br /> brought before Council because of the concerns that had been <br /> previously expressed about the land use. He felt that those issues <br /> had already been settled and the variances were the subjects to be <br /> reviewed at this time. He requested that the condition regarding <br /> prohibiting a left turn out of the lot should be included. <br /> <br /> Mr. Tarver reviewed the conditions listed in the staff report <br /> and expressed his concern with the notice of the public hearing. <br /> <br /> Ms. Acosta stated that staff's records showed that all people <br /> who artended the early meetings regarding the land use were <br /> notified by mail of the public hearing on the design and use. <br /> <br /> It was moved by Mr. Butler, and seconded by Mr. Tarvet, that <br /> Resolution No. 92-32 be adopted, denying the appeal and thereby <br /> approving the application of Jess C. Spencer Mortuaries, Inc. for <br /> front and rear yard setback variances for an approved mortuary <br /> building to be located at 4167 First Street subject to the <br /> conditions in the staff report and subject to the condition <br /> prohibiting funeral processions from making a left hand turn from <br /> the property. <br /> <br /> 2/4/92 <br /> 8 <br /> <br /> <br />
