9 <br /> <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Butler, Mohr, Scribner, Tarver, and Mayor <br /> Mercer <br /> NOES: None <br /> ABSENT: None <br /> ABSTAIN: None <br /> <br /> Item 6c <br /> P~3D-91-12, John Cerruti, Application for Planned U~t Developmen~ <br /> (POD) aDDroval to re~one 1.84 acres of land from the aaricultural <br /> zonin~ district to the PUD - LDR {Low Density Residential) DistriCt <br /> and for development Plan approval for a two lot s~qle-f~ily <br /> residential development (SR92:21) <br /> <br /> Mick Lamm, 147 Old Bernal, represented the applicant. He <br /> requested to have a maintenance agreement rather than to form a <br /> Homeowners Association as listed in the conditions of approval. He <br /> stated that staff was in agreement with this change. <br /> <br /> Ralph Romero, 2810 Foothill Road, stated that he agreed with <br /> this project and thought it looked beautiful. <br /> <br /> There being no further testimony, Mayor Mercer declared the <br />public hearing closed. <br /> <br /> Ms. Mohr asked that the condition concerning roofing reflect <br />whatever action was taken later that evening. <br /> <br /> It was moved by Ms. Mohr, seconded by Mr. ~Tarver, that <br />Resolution No. 92-09 be adopted, based on a review of an initial <br />environmental impact study done for this project and on a finding <br />that no significant environmental impact would occur as outlined in <br />the City's guidelines and on further finding that a negative <br />declaration is appropriate in connection with rezoning 1.84 acres <br />of land from the Agricultural zoning district to the PIID--LDR (Low <br />Density Residential) District and development plan for°a two lot <br />single-family residential development. <br /> <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Mohr, Scribner, Tarver, and Mayor <br /> Mercer <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br />117192 <br /> 9 <br /> <br /> <br />
