187 <br /> <br /> Mr. Burton explained the history of the ordinance. He stated <br /> that the original agreement was delayed from being signed by Mr. <br /> Ozbirn because he wanted a decontrol rent provision put in the <br /> agreement. When this was finally put into the agreement, Mr. <br /> Ozbirn signed it. <br /> <br /> Mayor Mercer pointed out that this problem applied only to <br /> this Park. He stated that the Council addressed all of the parks <br /> earlier this year. <br /> <br /> Mr. Burton agreed but referred to the agreement and stated <br /> that if one owner did not abide by the agreement, he would be the <br /> only owner subject to an ordinance. Four years ago the residents <br /> of the parks came to Council and asked for an ordinance. <br /> <br /> Mayor Mercer explained that the City is trying to take Mr. <br /> Burton's position on this matter, but the City needs to gather <br /> information before he can put a rent stabilization ordinance can be <br /> drafted. It seemed to Mayor Mercer that Mr. Burton did not want <br /> the City to do so. <br /> <br /> Mr. Burton answered that he does want a rent stabilization <br /> ordinance to be created. <br /> <br /> Bruce Stanton, Corporate Attorney for the Golden State Mobile <br />Homeowners League, represented the members of the Pleasanton Mobile <br />Home Park. He agreed that there should be rent survey completed <br />and was not opposed to an outside agency doing so. He understood <br />that before an ordinance is adopted, proper ground work should be <br />laid. He asked if the scope of the survey included all four parks. <br /> <br /> Mr. Roush stated that he would be directing the gentleman who <br />made the proposal to study the four mobile home parks in Pleasanton <br />as well as any parks within the immediate area if he felt that the <br />rents at these parks were relevant. <br /> <br /> Mr. Stanton stated that the Golden State Mobile Homeowners <br />League has surveyed similar parks before and that he would be <br />willing to give any information that may help in this study. He <br />believed that the ordinance that was proposed in the beginning of <br />1992 is similar to the terms of the agreement that was adopted. A <br />lot has happened since April of this year in terms of litigation <br />and other developments in other cities. Mr. Stanton felt that <br />Council is in a position where it can build in much better <br />protection into the ordinance. If the survey were to come back in <br />a favorable position for the adoption of the ordinance, he would <br />provide the City Attorney with copies of other ordinances and any <br />other information to help him view the issues and in turn bring a <br />recommendation to Council. <br /> <br />8/1B/92 9 <br /> <br /> <br />
