186 <br /> <br /> It was moved by Mr. Butler, and seconded by Ms. Mohr, that <br /> Resolution No. 92-165 be adopted, replacing the yield signs with <br /> stop signs on Forest Hill Drive and continuing police enforcement <br /> of speeding traffic along of Muirwood Drive. <br /> <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Butler, Mohr, Tarver and Mayor Mercer <br /> NOES: None <br /> ABSENT: Councilmember Scribner <br /> ABSTAIN: None <br /> <br /> Item 8b <br /> Consideration of Mobile Home Park Rent Stabilization Ordinanoe <br /> (SR92::328) <br /> <br /> Greg Burton, 4202 Stanley Boulevard #24, representative for <br /> Pleasanton Mobile Home Park, explained that 1) Mr. J. Wagner had <br /> stated verbally and in writing to the Pleasanton City Attorney that <br /> he does not recognize the current or new agreement providing for <br /> stabilization of mobile home space rents; 2) some rents in the <br /> Pleasanton Mobile Home Park had been raised beyond $245; 3) he has <br /> been led to believe that there have been improprieties with capital <br /> improvement done within the Pleasanton Mobile Home Park; 4) if the <br /> rents are raised to Mr. Wagner's satisfaction, at least three of <br /> the elderly tenants would be forced to move; 5) this park is a low <br /> income park; 6) there may be efforts to use short term evictions to <br /> avoid the stricter eviction proceedings; and 7) many of these <br /> mobile homes in the park are over 30 years old and would be <br /> difficult to relocate. Mr. Burton stated that the City of <br /> Pleasanton has made clear representations that it would pass a Rent <br /> Stabilization Ordinance for mobile home spaces if any park owner <br /> should neglect to fulfill its obligations under the provisions <br /> outlined in the agreement providing for stabilization of mobile <br /> home space rents. He concluded that the current agreement is not <br /> working. <br /> <br /> Mayor Mercer asked Mr. Burton if he had read the 'staff <br /> recommendation. <br /> <br /> Mr. Burton stated that he had not read all of it. <br /> <br /> Mayor Mercer then explained that the Council would appropriate <br /> $5000 to have the City Attorney arrange to have.the necessary study <br /> done to make a rent stabilization ordinance more defensible. <br /> <br /> Mr. Burton asked if that meant that the City needed a rent <br /> survey. <br /> <br /> Mayor Mercer reiterated that the City needed to spend $5000 to <br /> get more information to make the ordinance defensible in court. <br /> <br /> 8/ 8/92 8 <br /> <br /> <br />
