Mr. Sweeney and Joselyn Combs were unable to attend. <br /> There was general discussion at the meeting but it was decided that <br /> another meeting should be set according to Mr. Sweeney's schedule. <br /> <br /> 10. MATTERS CONTINUED FOR DECISION <br /> <br /> Item 10a <br /> AP-92-10/V-92-7# Michael D. 8chibler <br /> Appeal of the decision of the Planninq Commission denyinq an <br /> application for a variance from the Municipal Code to reduce the <br /> required fence setback for a street side yard of the residence <br /> located at 4298 Fairlands Drive. Zoninq for the property is R-1- <br /> 6500. (SR92:290) <br /> <br /> Mr. Schibler briefly described the position of his home on his <br /> street corner and the construction that had already taken place. <br /> He explained that by placing the fence at this particular location, <br /> it would reduce the street noise and his dog noise from his <br /> neighbors. He reiterated the discussion from the previous Council <br /> meeting regarding staff's position. Mr. Schibler handed out photos <br /> and drawings of his home and the changes which had already taken <br /> place. He explained that he was originally told by City staff that <br /> he did not need a building permit for this project but would need <br /> a variance. <br /> <br /> Mayor Mercer explained that he supported Mr. 'Schilber's <br /> request because he believed that this project would not have a <br /> significant impact on the neighborhood. He stated that because of <br /> the position of Mr. Schibler's home, the dog runs along the side of <br /> the home closest to the neighbors. This created a problem with the <br /> neighbors. Also, his children's bedroom windows face the street <br /> which allows the street lights to shine directly in. Mr. Schibler <br /> would need to move his fence poles to comply with the standards. <br /> Mayor Mercer felt that this would create a lot of unnecessary work. <br /> <br /> Mr. Tarver supported granting the variance but believed that <br /> the approval should be conditioned on the applicant landscaping the <br /> area. <br /> <br /> Mr. Butler did not support allowing the variance because he <br /> felt that Mr. Schibler should have followed the zoning <br /> requirements. <br /> <br /> 7/21/92 10 <br /> <br /> <br />
