It was moved byMr. Tarver, and seconded by Ms. Mohr, to adopt
Resolution No. 92-152, granting a variance for AP-92-10/V-92-07.

The roll call vote was as follows:
AYES: Councilmembers Mohr, Tarver and Mayor Mercer
NOES: Councilmember Butler
ABSENT: Councilmember Scribner
ABSTAIN: None

~1, LEGISLATIVE UPDATE REPORTS

There were none.

12. REPORTS OF THE CITY MANAGER

~tem 12a
Review of Unimproved Riqht of Way Area on Montevine Road

Brent Partridge stated that he came before Council in June and
left the meeting feeling confident that the area next to his
property would be landscaped. He spoke with Mr. Fulford,
Landscape Architect, who asked him what he wanted on the property
and if he were willing to purchase the property. He told Mr.
Fulford that he was asking for the property to have grass and
trees. He said that staff told him that most likely, that area
would not be developed into an intersection. He said that the
neighbors objected to having to landscape the area themselves. Mr.
Partridge believed that there were no other areas like this in
Pleasanton. He felt that it would benefit the neighborhood to have
an area for the children to play in. He then explained that all
new developments require one tree to be planted in the front of the
homes. He asked why that money could not be used to landscape this
small parcel. He asked where the park dedication from new
development monies get applied. He pointed out that this was an
unpleasant site next to $700,000 homes.

Mayor Mercer explained how park dedication funds are spent.

Mr. Tarver asked if Mr. Partridge would consider purchasing
this parcel if the Council decided it was surplus.

Mr. Partridge answered yes.

Mayor Mercer asked Mr. Partridge if it was his intent to build
a park on the parcel if he bought it.

Mr. Partridge said that he would like to place a hedge and
fence around it and use it as a back yard.

7/21/92 11
