147 <br /> <br />He was excited to bring to Council the approval of the Board <br />relative to this agreement and with the wholehearted desire to work <br />with the City Council and continue a 14 year old arrangement, which <br />was forged under trying circumstances. The District had to serve <br />Pleasanton because Pleasanton was in a hopeless and helpless <br />situation. <br /> <br /> Mr. Covello explained that they had worked very hard on this <br />revised agreement because of situations that had developed in the <br />last 14 years and what may develop in the future, such as TWA <br />developing treatment plant expansions outside the District <br />boundaries. The agreement only deals with treatment, not disposal. <br />Additionally, the agreement over the past few years has been <br />modified to deal with disposal through LAVMA. The District and the <br />City jointly funded the most recent LAVMA expansion. Mr. Covello <br />could not believe that a termination section is being considered. <br />He explained that the last 14 years had been spent becoming <br />partners and what was put in this agreement was the exact same <br />words as the previous one. He urged Council to approve this <br />revised agreement which benefits the City far more than it does the <br />District. <br /> <br /> Mayor Mercer stated the friendship and respect developed with <br />the District over the past 14 years. He indicated that he and Mr. <br />Butler did not share the concern expressed by another City <br />Councilmember regarding a possible termination section in this <br />agreement. Mayor Mercer believed that Mr. Covello runs a wonderful <br />Sewer District. The City of Pleasanton is extremely fortunate to <br />have had DSRSD as a partner to provide sewer to the City. He <br />suggested that DSRSD and City staff provide a staff report for the <br />next City Council meeting which would explain a termination section <br />and the reason it is not needed. <br /> <br /> Mr. Covello asked what was wrong with the previous agreement. <br />He still did not understand the reasoning behind this request. <br /> <br /> Ms. Mohr explained that she works with contracts a lot in her <br />business and in doing so she understood that in order for a <br />contract to be complete, there must a beginning and an end. She <br />asked staff what type of end does a contract like this one require. <br /> <br /> Ms. Acosta explained that there was a valid question raised by <br />Councilmember Tarver regarding the term of the contract. She <br />understood that Mr. Tarver found the content of the contract <br />acceptable, but questioned the term. She believed that the working <br />relationship that has been developed could not be better. Staff <br />has been very satisfied with what was occurring at the plant. She <br />suggested that Council move forward and consider this item, <br />isolating the termination issue and bringing that issue back to <br />Council at a later date. This would enable City staff and DSRSD <br />staff to work together to create a solution. <br /> <br />10/20/92 17 <br /> <br /> <br />
