146 Mr. Butler appreciated the comments and suggestions from the Kottinger Hills Homeowners Association. He explained that he had to rely on the process of the General Plan and EIR and concluded that a project with 86 units has no significant impacts. It falls well below what was anticipated in the General Plan. The traffic impacts are insignificant and that was his preference a month ago. He recognized the concern of school issues, and felt that Council had provided a mechanism for the School Board to solve that problem, as listed in the conditions of approval. Council is unable to deal with the issue directly because school facilities are not in its jurisdiction. It was moved by Mr. Butler, and seconded by Mayor Mercer, that Ordinance No. 1579 be reintroduced, to be read by title only and waiving further reading thereof, approving the application of Chang Su-O Lin (Kottinger Hills) for an 86 unit project with a golf course and requiring no secondary access road. The roll call vote was as follows: AYES: Councilmembers Butler, Mohr and Mayor Mercer NOES: Councilmember Scribner ABSENT: Councilmember Tarver ABSTAIN: None Mr. Fairfield clarified that the motion included a golf course. Mr. Butler answered yes. 11. LEGISLATIVE UPDATE REPORTS There were none. 12. REPORTS OF THE CITY MANAGER Item 12a Report on Revised Agreement with Dublin San Ramon Services District (SR92:429) Ms. Mohr asked about language regarding a termination section. Ms. Acosta answered no. She suggested that Council approve the agreement presented this evening and then termination language would come back to Council for approval. Joe Covello, represented Dublin San Ramon Services District, Board of Directors, stated that he was excited about this agreement and at the same time distressed. 10/20/92 16
