148 <br /> <br /> Mayor Mercer stated that it was the City's policy that if a <br /> Councilmember asks for further information, it be provided before <br /> making a final decision. He had a lot of empathy for Mr. Covello's <br /> concerns. He assured Mr. Covello that there was no other <br /> organization in the Valley that he would like to be in a <br /> partnership with than with DSRSD. <br /> <br /> Mr. Covello said that his honor had been impinged. He added <br /> that the City would have a hard time developing a termination <br /> section that DSRSD would accept. <br /> <br /> Bob Beebe, Dublin San Ramon Services District, explained that <br /> the wording in the proposed agreement does allow a termination. It <br /> provides for a negotiated termination by subsequent agreement. The <br /> issue is not whether DSRSD or the City could get out of the <br /> agreement; it is whether one or the other could get out of it <br /> unilaterally. <br /> <br /> Mr. Butler added that this Committee and staff had put a lot <br /> of effort into this agreement. He was very satisfied with the new <br /> agreement, as drafted. He did not object to staff trying to answer <br /> whether there are adequate provisions as to termination. <br /> <br /> It was moved by Mr. Butler, and seconded by Ms. Mohr, <br /> approving the Agreement for Wastewater Disposal Services with <br /> Dublin San Ramon Services District; with verbiage for a termination <br /> section to come back to Council in November. <br /> <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Butler, Mohr, Scribner and Mayor Mercer <br /> NOES: None <br /> ABSENT: Councilmember Tarver <br /> ABSTAIN: None <br /> <br /> Mayor Mercer asked that it be included in the record that he <br /> would have voted for this agreement without a termination section. <br /> He believed that DSRSD has done everything possible to assist the <br /> City to provide sewer service. The citizens of Pleasanton are <br /> fortunate to have a nationally recognized sewer treatment facility <br /> handling their needs. <br /> <br /> 13.
