66 <br /> <br /> Mr. Swift explained that staff did not have a problem with the <br /> modification to Condition 2 and did not intend to preclude the <br /> grading or construction of the golf course until the residential <br /> project moved forward. Condition 5a is a condition that staff had <br /> been including with all PUDs for 3 to 4 years. To modify this <br /> condition would be a change from what had been required in the past <br /> but it was not a c~de requirement. <br /> <br /> Mr. Tarver felt that this was a situation where this was an <br /> election year fire sale and that Council was changing the rules at <br /> the eleventh hour to give an applicant project approval with <br /> guarantees for future years. He definitely did not support the <br /> motion. <br /> <br /> Mayor Mercer stated that nobody was giving any guarantees. He <br /> indicated that he and Mr. Butler would not be on Council when <br /> growth management would be considered. <br /> <br /> Mr. Swift added that staff would bring back at the next <br /> meeting the final language for the environmental impact findings, <br /> the overriding findings, the environmental monitoring, and final <br /> conditions of approval. <br /> <br /> Item 13b <br /> AP-92-14/UP-92-33, Dennis Leroy Thomson <br /> <br /> Appeal by the City Council of a decision of the Planning Commission <br /> aDDroving an application for a conditional use permit to establish <br /> a country western dance facility within the existing Vintage Hills <br /> Shopping Center located at 3550 Bernal Avenue. Zoning for the <br /> property is PUD (Planned Unit Development) - C-N (Neighborhood <br /> Commercial) District. (SR92:384) <br /> <br /> Mr. Mercer declared the public hearing open on the <br /> application. <br /> <br /> Jacki Clark explained that she and her husband were partners <br /> with Kathy and Leroy Thomson on this project. She reiterated the <br /> staff report and believed that they were providing a need that is <br /> evident in Pleasanton for country western dancing. She described <br /> the facility as a dance studio, with lessons being held five nights <br /> a week and some dancing on the weekends. The type of dancing that <br /> will be taught would be mostly line dancing. Line dancing is a <br /> skill and must be practiced. The dancing does require a large <br /> dance floor as well as someone to select the music that is <br /> appropriate to the dance. <br /> <br /> Ms. Clark stated that she was willing to meet the conditions <br /> that were listed by the Planning Commission. She reiterated that <br /> staff found the noise level is within an acceptable level according <br /> to City code.
