65 <br /> <br /> It was moved by Mr. Butler, and seconded by Mayor Mercer, to <br /> approve layout (Concept) E but leave in condition 9a. <br /> <br /> The roll call vote was as follows: <br />AYES: Councilmembers Butler, Mohr, and Mayor Mercer <br />NOES: Councilmembers Scribner and Tarver <br />ABSENT: None <br />ABSTAIN: None <br /> <br /> It was moved by Ms. Mohr, and seconded by Mr. Butler, that the <br />proposed neighborhood park be public; and to refer to the Park and <br />Recreation Commission the location of the park in the project area. <br /> <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Mohr, Scribner, Tarver and Mayor <br /> Mercer <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br />It was moved by Mr. Butler, and seconded by Ms. Mohr, <br />(1) requiring the developer to apply for allocation of residential <br />units under the City's Growth Management Program (GMP), as follows: <br />"Submittal of an application for tentative map, vesting tentative <br />map, or any subdivision map approval for the residential portion of <br />the project shall not be accepted until the project has received <br />its GMP allocation. The golf course suites shall be subject to <br />normal GMP requirements; should the developer fail to receive <br />growth management approval within 2-1/2 years of PUD approval the <br />development plan shall be of no further validity and the developer <br />shall be required to submit the same or new development plan for <br />City approval prior to development of the site"; (2) approving the <br />requirements for the performance bond; and (3) removing the words <br />"use its best efforts" from Condition 78 so that the sentence reads <br />"The developer shall construct a temporary road separate from <br />existing residential development directly from the site northerly <br />to Vineyard Avenue to serve as a haul route for heavy construction <br />traffic during the initial site construction phases of the <br />project." <br /> <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Mohr, Scribner, and Mayor Mercer <br />NOES: Councilmember Tarver <br />ABSENT: None <br />ABSTAIN: None <br /> <br /> Mr. Tarver asked if this was a deviation from the standard <br />operating procedures that Council had used in the past. <br /> <br />9/15/92 39 <br /> <br /> <br />
