134 <br /> <br /> Margaret Tracy, PreserveArea Ridgelands Committee, indicated <br /> that PARC agrees that a major PUDmodification is required for this <br /> project. She presented her concerns about the environmental review <br /> <br /> Mayor Tarver limited the discussion on this item because the <br /> applicants desired to withdraw their objection to the major <br /> modification to the PUD. <br /> <br /> It was moved by Ms. Scribner, and seconded by Ms. Dennis, to <br /> permit the applicants to withdraw their appeal from the Planning <br /> Director's determination that a major modification to the PUD is <br /> required; thatthe studies identified in the conditions of approval <br /> of the PUD which were to be completed with the tentative map will <br /> be completed as part of the major modification to the PUD; that the <br /> growth management agreement be amended to provide that except for <br /> the 14 custom lots, 47 building permits must be obtained prior to <br /> 12/31/94 to 12/31/95, or else the growth management approvals <br /> representing those units will be lost; and that the Planning <br /> Commission consider the creation of an assessment district, rather <br /> than a homeowners association, to address the geological conditions <br /> which exist on the property. <br /> <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Dennis, Mohr, Pico, Scribner and Mayor <br /> Tarver <br /> NOES: None <br /> ABSENT: None <br /> ABSTAIN: None <br /> <br /> There was a brief recess from 9:12 p.m. to 9:20 p.m. <br /> <br /> Item 7c <br /> Item 4i <br /> Approve the Final MaD, Improvement Plans, and Subdivision nqreement <br /> for Tracts 6483 and 6518, Bonde Ranch. ShaDell Industries. <br /> (SR93:121) <br /> <br /> Mr. Swift presented the staff report. <br /> <br /> Woody Pereira, 43 Golf Road, indicated that this plan will <br /> work with or without the connection to Miradot Drive. The <br /> developer has conformed with all of the conditions of the tentative <br /> map and the PUD. Me listed all fees paid to the City. He asked <br /> that the final maps be approved so that the developer can proceed <br /> with construction. If Council desired, the appropriate hearings <br /> could be scheduled on the opening of Mirador Drive. He would have <br /> no objection at that time to revise the final map after the <br /> hearings.
