PUBLIC HEARINg8 <br /> <br />Item 7a <br />AP-93-1 (UP-92-68) Kimberely Mullen <br /> <br />APPLICATION WITHDRAWN <br /> <br />APpeal of Decision of the planninq pirector that a Ma~or <br />Modification to the Moller Ranch Planned U~$~ Development {PUD-90- <br />19) is reauired in conjunction wi~h the Submission of a tentative <br />mad ~or the ~ro~ect {to be heard w~h a qeneral discnassiQ~ 2bou~ <br />the Moller Ranch PrO~ect) (SR93:128) and (SR93:134) <br /> <br /> Mr. Swift presented the staff reports. <br /> <br /> Mayor Tarver asked if it were possible to change the growth <br />management conditions if it was determined that the tentative map <br />application did not need a major modification to the PUD. <br /> <br /> Mr. Roush answered no. <br /> <br /> Don Wallace, property manager for the Mollers, explained the <br />history of this property and the Moller family. He described the <br />project and asked for Council approval. <br /> <br /> Peter MacDonald, 400 Main Street, represented the Moller <br />family. He indicated that the Mollors were willing to amend their <br />Growth Management Agreement to reflect a "use it or lose it" <br />policy. He explained the studies that have been made on the site <br />and the environmental changes made. He indicated that the Mollers <br />would agree to process the application as a major modification. <br />They would like to know of any major concerns with the project at <br />this point. They were hoping that they could proceed in accordance <br />with the current General Plan. <br /> <br /> Ms. Dennis asked if they would be willing to consider an <br />assessment district for management of the open space area rather <br />than a homeowners' association. <br /> <br /> Mr. MacDonald agreed that an assessment district was a good <br />idea. <br /> <br /> The following people spoke in favor of this application: Fred <br />Hempy, 7646 Cottonwood Lane; Neal Sweeney, 741 E. Angela Street; <br />George Lydickson; Gordon Rasmussen, 6000 Highland Road; Tim <br />Koopmann, 9464 Pleasanton-Sunol Road; and Dorothy Bevard. <br /> <br /> Reno Cairo, 218 E.
