87 <br /> <br /> Mayor Tarver asked if staff knew whether the intensity of use <br />on the fairgrounds would increase or decrease. He asked staff to <br />explain the condition regarding the pro-rata share calculations on <br />the infrastructure after this development takes place and what <br />mechanism is used to insure that this project will be completed. <br />He was also concerned with bonding the public improvements to <br />ensure that they are completed in a timely manner. <br /> <br /> Mr. Swift explained that staff's estimation for water and <br />sewer lines are based on current costs in the City's Capital <br />Improvement Program. He added that no matter how the Martinique <br />property is developed, this project would have to construct the <br />water and sewer lines. <br /> <br /> Mr. Pico asked for an explanation regarding the limit of <br />growth management approval. <br /> <br /> Mr. Swift indicated that this project does not have growth <br />management approval. It could either apply for growth management <br />in the spring or develop over a period of two years, with two <br />subdivisions of five or fewer units. <br /> <br /> Mr. Tarver declared the public hearing open on the <br />application. <br /> <br /> David Jones, 1605 Rose Avenue, reiterated the history of this <br />project. He referred tothe alternate accesses and indicatedthat <br />there is no agreement with the Alameda County Fairgrounds for the <br />easement. He was discouraged with the process he has had to go <br />through to receive approval. <br /> <br /> Ernest Jones, 1725 Rose Avenue, disagreed with the following: <br />1) having to build a soundwall for the Fairgrounds benefit; 2) a <br />recorded disclosure notice; 3) water and landscaping of the nine <br />foot piece of property on the Fairgrounds; and 4) the pro-rata cost <br />on the sewer. He believed that the homeowners should be charged <br />for that. <br /> <br /> David Jones added that the 1988 sewer plan was designed to <br />accommodate future flows to the east. He then reiterated the <br />concerns that his father shared. <br /> <br /> Mr. Swift explained that the conditions that the Jones' were <br />referring to were Conditions 7, 11, 15, and 17. <br /> <br /> Mayor Tarver indicated that there is no restriction to prevent <br />anyone from petitioning the Fair Board to do what is appropriate on <br />their property. The developer would not be responsible, as the <br />condition is written, for the landscaping; the City would maintain <br />the property across the street from the project. <br /> <br />02/16/93 5 <br /> <br /> <br />
