REPORTS OF THE CITY ATTORNEY <br /> <br />Item 13a <br />Consideration of Mobile Home Park Rent Stabilization Ordinance <br /> <br /> Mr. Roush presented the staff report. He indicated there is <br />a mobile home rent stabilization agreement with three of the four <br />parks. Over the past year, attempts have been made to reach an <br />agreement with the fourth park owner, Mr. Wagner. Staffs' efforts <br />and the efforts of the Mobile Home Committee have been to no avail. <br />Staff has proposed a mobile home rent ordinance, which will allow <br />the owner to raise rents based on certain expenses. If the owner <br />feels that is not enough, there is a procedure for the owner to <br />petition for increased rents. There is also a procedure for the <br />tenants to petition if there is a reduction in service levels <br />without a reduction in rents. <br /> <br /> Staff would prefer to have reached an agreement. The 1988 <br />agreement has expired as of the end of 1992 and without either an <br />agreement or an ordinance, the park owner can give a 60 day notice <br />to tenants and raise rents to whatever he feels is appropriate. <br />Staff has presented the ordinance to stabilize rents at this <br />particular mobilehome park. <br /> <br /> Mr. Tarver asked for clarification on the $100 administrative <br />fee. <br /> <br /> Mr. Roush indicated it is $100 per space to be paid by the <br />owner. The owner can recover the tenant's portion as part of a <br />rent increase. <br /> <br /> Milan Dobro, Regional Manager for the Golden State Mobilehome <br />Owners League (GSMOL), indicated what is being considered is rent <br />of a dirt pad, not a dwelling. The tenants have bought their homes <br />and are renting the dirt on which it rests. He indicated legal <br />precedent firmly establishes the right of a local agency to use its <br />police power to adopt a rent control ordinance.
