He then explained the street improvements condition. <br /> <br /> Mr. Pico referred to condition 19 and asked what would happen <br /> if a future Council decided that it did not want to condemn the <br /> property after the tentative map is approved. He then asked for <br /> clarification on Conditions 24, 25 and 38. <br /> <br /> Mr. Swift stated that if Council were not to acquire this <br /> right-of-way, then that requirement of the project would be waived <br /> per the Subdivision Map Act. Council has established the right-of- <br /> way to be expanded to the south and east of Stanley Boulevard. <br /> There is not sufficient room in the existing right-of-way to <br /> construct the proposed new street improvements. If Council desires <br /> to move the right-of-way north and west of Stanley Boulevard, it <br /> would require removal of the walnut trees on Stanley Boulevard. It <br /> would also require a revision of the entire plan. <br /> <br /> Ms. Scribner asked if Stanley Boulevard, as presented tonight, <br /> is the same right-of-way that Council previously approved. <br /> <br /> Mr. Swift answered yes. <br /> <br /> Mayor Tarver asked if the Planning Commission agrees with <br /> staff that this project should not be rezoned. <br /> <br /> Mr. Swift stated that the Planning Commission recommended <br /> denial of the general plan amendment. The Planning Commission did <br /> support High Density Residential when it was changed from <br /> Commercial. <br /> <br /> Mr. Tarver declared the public hearing open on the <br /> application. <br /> <br /> Lisa Kalmbach, President of Kaufman & Broad Southbay, 2201 <br /> Walnut Avenue #150, Fremont, 94538, requested that Council approve <br /> the tentative map for this project and deny the appeal. She <br /> explained that she had met with the neighbors and staff to address <br /> any concerns that they had to make this a better project. She <br /> reiterated that 15% of the units are reasonably priced and Kaufman <br /> and Broad will be offering a creative financing program. The <br /> remaining units will range from $220,000 to $240,000. She offered <br /> to answer any questions that Council might have. <br /> <br /> Mr. Pico asked for Ms. Kalmbach to point out where the <br /> affordable housing units would be located within the project. <br /> <br /> Ms. Kalmbach stated that the location of those units had not <br /> been determined. <br /> <br /> 1/5/93 <br /> <br /> <br />
