11 <br /> <br /> Mayor Tarver did approve of the project but believed that <br />Condition 5 (eminent domain) should be removed, there should be <br />bonding and timing limitations on the infrastructure and growth <br />management issues should be visited again. He felt that the growth <br />management was not coinciding with the construction of this <br />project. <br /> <br /> It was moved by Ms. Scribner, and seconded by Ms. Mohr, to <br />deny the City Council appeal (AP-92-25) thereby upholding the <br />Planning Commission's approval of Vesting Tentative Map 6596, the <br />application of Brad Hirst and James Tong. <br /> <br />The roll call vote was as follows: <br />AYES: Councilmembers Mohr and Scribner <br />NOES: Councilmember Pico and Mayor Tarver <br />ABSENT: None <br />ABSTAIN: None <br /> <br /> The Tentative Map was deemed approved by operation of law. <br /> <br /> Council recessed at 9:10 p.m. for a break. <br /> <br /> Council reconvened at 9:15 p.m. <br /> <br />Item 6e <br />AP-92-24 Vestinq, Tentative Tract Map 6545, Kaufman and Broad, <br />Inc./California Reflections <br />Appeal bv City Council of the decision of the Planning Commission <br />approvinq an application for a vestinq tentative tract map to <br />subdivide. an approximately 17-acre parcel into 108 sinqle-family <br />lots and four remainder parcels consistinq of roadways and park <br />area located at 3801 Stanley Boulevard. Zoninq for the property is <br />PUD fPlanned Unit Development) - Low Density Residential District. <br />(SR93:12) <br /> <br /> Mr. Swift presented the staff report. <br /> <br /> Mr. Pico understood that while this project may be in <br />conformance with the PUD, staff has reservations as to whether this <br />is a proper land use for this site. Mr. Pico shared his concern <br />with the traffic circulation within the project. He asked if the <br />standard conditions were the same conditions as those in the <br />Planning Commission reports. He understood that a final plotting <br />plan has been submitted and that all of the homes that back onto <br />Stanley Boulevard, with soundwalls behind them, are two story <br />homes. Mr. Pico was concerned with the two story homes and the <br />soundwalls impacting the view shed of the hills and mountains. <br /> <br /> Mr. Swift explained that staff recommended denial of the <br />general plan amendment, but the PUD was approved for this site <br />because it was felt high density residential was a better use for <br />the site.
