97 <br /> <br /> Mr. Pico believed he was being forced to take this action because of approvals by the <br /> prior City Council which he felt restricts any future Council from taking action on Ruby Hill <br /> to protect the public health and safety. He had strong reservations about having his hands tied. <br /> <br /> It was moved by Ms. Dennis, seconded by Mr. Pico, to reconsider the prior action which <br /> had disapproved the final map for Tract 6554, Ruby Hill. <br /> <br /> The vote was aS follows: <br /> AYES: Councilmembers Dennis, Mohr, Pico, Scribner, and Mayor Tarver <br /> NOES: None <br />OlD ABSENT: None <br />CO ABSTAIN: None <br /> <br /> Jim McKeehan, Signature Properties, indicated that prior to the final map before Council <br /> this evening, three other final maps for this project had been approve& Thousands of hours and <br /> dollars were spent in preparing a market program for the project. When the newspapers <br /> reported that the City Council had stopped Ruby Hill, the entire marketing program was <br /> impacted and hours were required to reassure prospective buyers. Mr. McKeehan asked Council <br /> to please contact Signature Properties with questions or problems before taking action in the <br /> future. <br /> <br /> Mr. McKeehan referred to the remarks of Mr. Pico about having his hands tied with <br /> regard to protecting the health and safety of the citizens. Mr. McKeehan indicated this project <br /> was approved by the County with numerous conditions imposed. When the property annexed <br /> to Pleasanwn, more conditions were imposed, including realigning the 'S" curve. Signature <br /> Properties has gone the extra mile to satisfy the concerns of Pleasanton and all tools are <br /> available for the Council to protect its citizens. He urged Council to work with Signature to <br /> meet all their mutual goals. <br /> <br /> Sharrell Michellotti, 7873 Olive Court, believed that Council had put the City and its <br /> taxpayers at risk of considerable litigation costs by its prior action denying the final map. She <br /> stated her view that Council's job is to act for the good of the community, not its own agenda. <br /> She urged Council to approve the final map and work with the developer. <br /> <br /> Ms. Mohr also indicated her belief that some of Council had denied the final map for <br /> Tract 6554 only to advance a private agenda. She stated the City Attorney had previously <br /> informed Council of the procedures regarding final map approvals and Council cannot pick and <br /> choose what laws to uphold. <br /> <br /> Mr. Tarver was sorry about the impression that Councilmembers had a private agenda. <br /> He also expressed regret for not calling Signature Properties with concerns before the last <br /> meeting. He believed that speaking about a project's safety is the duty of Councilmembers.
