96

Ms. Mohr felt the current configuration is difficult and cumbersome. If downtown
becomes more successful, that comer could become gridlocked. She believed Council should
reserve the potential to respond to a future problem.

Mr. Van Gelder confirmed that at built out in downtown, that intersection will be over
capacity.

Mr. Pico indicated the two foot right of way Ray Street could be reserved.

Mr. Swift pointed out that there are no setback requirements in the downtown area. In
fact, businesses are encouraged to build right to the property line.

It was moved by Ms. Scribner, seconded by Mr. Pico, that Resolution No. 93-138 be
adopted, to provide that no change be made to the existing alignment of Ray and St. lohn Streets
at Main Street other than to direct staff to consider reserving two feet on the southern portion
of the Chevron service station site for right of way purposes, in conjunction with any future
development of the site.

The vote was as follows:
AYES: Councilmembers Dennis, Pico, Scribner, and Mayor Tarver
NOES: Councilmember Mohr
ABSENT: None
ABSTAIN: None

7. Improvement Plans and SubdivisiOn Agreement for Tract
Rl~by Hffi, Sit, nature Properties

Mr. Roush presented the staff report. He indicated the findings to disapprove the final
map were not specific enough in the event of litigation. He asked Council to reconsider its prior
action. He also recommended that Council approve the final map because it is consistent in all
ways with the tentative map. To address Council's concerns regarding the "S" curve on
Vineyard Avenue, the developer has proposed a construction schedule which would result in the
work to occur this summer.

11/02/93 4
