84

Richard Flores, 1531 Merritt Lane, Livermore, spoke in support of this ordinance but
suggested that Council postpone the adoption until the surroundings cities pass such an --
ordinance.

Frank Eich, 5907 Black Avenue; Sharon Roller, Health Educator at Kaiser Permanente;
Roger Gallve, 3211 Gulfstream Street; and Michael Keegan, 3537 Arbor Court, all spoke in
support of this ordinance.

Ms. Scribner asked if businesses in Pleasanton were notified of this ordinance.

Mr. Roush explained that staff referred this matter to the Chamber of Commerce which
is standard procedure for ordinances that impact businesses. There were no specific notices that
were sent out to each bar and restaurant in the community.

Ms. Scribner pointed out that she had recently attended a seminar regarding this subject
and reiterated the statistics and results of the studies taken. She supported the smoke-free
environment in the work place and restaurants. She did not object to allowing bars to have
smoking. She also would not object to having a separate area or room designated for smokers
in the work place if that area was on a separate ventilation system.

Mayor Tarvet strongly supported this ordinance. He did object to bars and other single
uses allowing smoking because it does not address the problem of the employees' health. He
did not believe that this would pose an economic problem.

Ms. Dennis also strongly supported this ordinance.

Mr. Pico and Ms. Mohr supported this ordinance but would be willing to reconsider it
if the surroundings cities did not adopt a comparable ordinance. Ms. Mohr was willing to
consider reasonable exceptions between this date and the effective date of January 1, 1994.

It was moved by Ms. Scribner, and seconded by Ms. Mohr, that Ordinance No. 1609
be adopted, amending chapter 9.24 of the Pleasanton Municipal Code Concerning Smoking in
Public and Work Places; to be considered further by Council the first meeting in January 1994.

The roll call vote was as follows:
AYES: Councilmembers Dennis, Mob. r, Scribner, Pico and Mayor Tarvet
NOES: None
ABSENT: None
ABSTAIN: None

Council took a break at 8:56 p.m.

Council reconvened at 9: 03 p.m.

10/19/93 6
