68

Mr. Pico felt that a later effective date should be set. This would give all cities an
opportunity to coordinate the effectiveness of this ordinance. He understood that the hotels
needed sufficient time to convert their rooms. He would not object to allowing the hotels to
convert within one year from the date of the ordinance. He would be willing to consider some
flexibility with having smoking and non smoking on the same floor as long as the rooms had
separate ventilation supplies.

It was moved by Ms. Mohr, and seconded by Ms. Scribner, that Ordinance No. 1609
be introduced, to be read by title only and waiving further reading thereof, amending Chapter
9.24 of the Pleasanton Municipal Code concerning smoking in public and work places effective
January 1, 1994; modifying Section 9.24.040 (14) to read as follows: "Private hotel and motel
rooms rented to guests, except that up to twenty-five percent (25 %) of such rooms may be
designated for smoking guests, if on a separate floor or on a separate wing."; hotel operators
are allowed up to six months to convert rooms to non-smoking and if unable to do so, an
extension may be requested.

The roll call vote was as follows:
AYES: Councilmembers Dennis, Mohr, Pico, Scribner and Mayor Tarver
NOES: None
ABSENT: None
ABSTAIN: None

7:30 p.m.

12. MEETING OPEN TO THE PUBLIC

Kaufman and Broad - Affordable Housing

Susan Solis, 3294 W. Las Positas, resident of a Kaufman and Broad project, voiced her
concern and disappointment in the quality of these homes. She felt that the City should be
aware of the problems that residents have been having.

Ms. Acosta agreed to meet with the Director of Building Services to discuss the concerns
expressed by the homeowners.

Kottinger Hills Referendum

Rosiland Wright, 5331 Northway Road, spoke in response to the recent newspaper
articles regarding Kottinger Hills. She expressed her opinion that Council should respect the
voters and not change the rules.

10/12/93 6
