The roll call vote was as follows: <br />AYES: C ouncilmember Ayala and Mayor Tarver <br />NOES: Councilmembers- Dennis, Michelotti, and Pico <br />ABSENT: None <br />ABSTAIN: None <br /> <br /> It was moved by Ms. Ayala to direct staff to develop a pre- <br />annexation/development agreement incorporating into that the $1.2 million for the <br />sewer and water to be substituted by construction by the developers and that a PUD is <br />brought back to Council as soon as possible. <br /> <br /> Mayor Tarver wanted to know if Ms. Ayala wanted a development agreement <br />without a PUD specifics, if so, say it. <br /> <br /> It was moved by Ms. Ayala, seconded by Ms. Michelotti, to direct staff to <br />develop a pre-annexation/development agreement without a PUD with as many <br />specifics as possible. <br /> <br /> Mayor Tarver could not support the motion because there was no PUD. Council is <br />going around in circles. It is possible that on November 16 there will be a vote that will <br />have a majority plus one that will support annexation. It is a big risk to take. The areas of <br />concern are known: bypass road certainty and infrastructure costs. If you can put that in a <br />document that lets them understand there will be a bypass road and infrastructure will be <br />paid for, he felt there could be a majority plus one vote to annex. If that is not delivered to <br />the residents, they will not vote for annexation. <br /> <br /> Ms. Ayala asked why Mr. Pico was not in favor of this. It takes care of the concerns <br />of the Happy Valley residents. <br /> <br /> Ms. Michelotti asked what if the PUD is not ready by November. <br /> <br /> Mayor Tarver said if the PUD is not ready, when the residents vote on <br />November 16, you have not fulfilled your commitment. There is nothing in writing to take <br />care of their concerns. Mr. Tarver understood Mr. Pico has serious concems about the New <br />Cities development and he has concerns too. Council will have a public hearing on that <br />project. If Mr. Pico felt the project could not salvaged, he could vote against that. He could <br />lead a referendum drive. There are many things to do about the decision, but it should not <br />interfere with this whole process. <br /> <br /> Mr. Pico was moved by Mayor Tarver's eloquence and asked if he had made a <br />motion. <br /> <br /> He said he did.
