Mr. Pico said we don't know if the contamination is there, but that is why we <br />need to stop this use until we do know. He wanted Council to direct staff to request an <br />injunction to cease operations on the property until it can be demonstrated there is no risk <br />to the public health. <br /> <br /> Ms. Michelotti said the only way we can resolve this immediately is for the City <br />of Pleasanton to take on the task. We have no facts. <br /> <br /> Mr. Pico felt there was enough information to know that there is a potential <br />problem. The Planning Commission denied approval of the EIR for the property based <br />on this information. He wanted facts and information and did not want to wait a year for <br />San Francisco to perform a study. In the meantime, the School District is building an <br />elementary school in the area. <br /> <br /> Ms. Michelotti wanted to know what action San Francisco is going to take. <br /> <br /> Mr. Pico said that in the meantime the dirt is continuing to be tilled and dust is <br />blowing. <br /> <br /> Mr. Tarver supported writing a letter. <br /> <br /> Ms. Michelotti said no action could be taken unless we add it to tonight's <br />agenda. She could not support action that would make the public believe that the dust <br />blowing off the property is contaminating them without some basis of knowledge. <br /> <br /> Mr. Tarver said that is the point of the environmental document that states <br />further study is needed. The facts seem to support the possibility that the nuclear <br />laundry, when it was operating, processed through our sewer plant radionuclides that <br />were deposited on these ponds. We need further study; do you do it before, after, or stop <br />operation on the property completely until we confirm. <br /> <br /> Ms. Michelotti agreed investigation needs to be done. <br /> <br /> Mr. Tarver said there is a question of public safety. If the agricultural use <br />proceeds and nothing is found then there is no problem; but if you are wrong, then there <br />is a significant consequence. <br /> <br /> Ms. Michelotti had an uneasy feeling about declaring an emergency when she <br />did not have the facts. <br /> <br /> Ms. Ayala suggested discussing this at the July 29, 1999 meeting. <br /> <br /> Mr. Roush said there could be a closed session because potential litigation is <br />being discussed and in the interim, staff will be meeting with the San Francisco staff and <br /> <br />Pleasanton City Council 22 07/20/99 <br /> <br /> <br />
