Mr. Roush said that if there is a further proposed settlement document regarding <br />the Altamont Landfill expansion litigation, there will be language similar to what was <br />suggested by Ms. Cebanne included in that document. He was not certain that needed to <br />be in this letter. As a practical matter that language will be included in further settlement <br />discussions. <br /> <br /> Mr. Pico would agree to adding a sentence to the letter that this incident gives us <br />grave concern about the proposed expansion and the settlement of the existing litigation, <br />or some general statement to recognize that we have real concerns. <br /> <br /> Ms. Ayala said there is a sentence in the letter that says ".. we support your <br />position that any permitted expansion of the Landfill must not be approved until the soil <br />is removed." We could easily add a sentence there. <br /> <br /> Mr. Tarver said we could add a further sentence that further expansion of the <br />landfill insures that nothing like this will ever happen again. <br /> <br /> Mr. Pico agreed to amend the motion to include that. <br /> <br /> It was moved by Mr. Pico, seconded by Ms. Michelotti, to send the proposed <br />letter, with the revisions discussed above, to the Alameda County Board of <br />Supervisors. <br />The roll call vote was as follows: <br />AYES: Councilmembers - Ayala, Michelotti, Pico, and Mayor Tarver <br />NOES: None <br />ABSENT: Councilmember Dennis <br />ABSTAIN: None <br /> <br />7. MATTERS INITIATED BY COUNCIL <br /> <br /> Mr. Pico referred to the plowing of the San Francisco Bernal Avenue property <br />and the dust cloud that was blowing over the school and residential areas. He was very <br />concerned that if there is any contamination of any part of that property, the agricultural <br />uses must immediately stop any disturbing of the soil until it can be proved there is no <br />risk to the public. He had serious concerns about the health risks and wanted Council to <br />take immediate action. <br /> <br /> Mr. Tarver said that would have to be a request to the County, since the City of <br />Pleasanton has no jurisdiction. <br /> <br /> Mr. Roush indicated a request could be sent to the County, but the City could <br />also make a request of the operator, if the activity on the property is in fact a serious <br />health risk. <br /> <br /> Ms. Michelotti wanted some facts about the operation.
