There needs to be a four-fifths vote to add it to the <br />agenda based on grounds that the situation arose after the agenda was posted and cannot <br />wait until the next meeting. <br /> <br /> It was moved by Mr. Tarvet, seconded by Ms. Ayala, to add an agenda item <br />to discuss sending a letter to San Francisco to stop turning over the soil on that <br />property until it has been tested. <br /> <br /> Ms. Michelotti objected to that because there is no basis for doing that now. She <br />would support discussing this at the July 29, 1999 meeting. <br /> <br />The roll call vote was as follows: <br />AYES: Councilmembers -Ayala, Pico, and Mayor Tarver <br />NOES: Councilmember Michelotti <br />ABSENT: Councilmember Dennis <br />ABSTAIN: None <br /> <br /> The motion failed because a four-fifths vote to add the item was not obtained. <br /> Ms. Michelotti wanted the fence around the ACE station completed. <br /> <br /> Ms. Acosta said the problem is there is already a wall there and no fight of way <br />within which to build the fence. Staff is trying to negotiate to put the wall in different <br />locations and is still working on that. <br /> <br /> Ms. Michelotti asked for an update from the Congestion Management Agency <br />representative. She referred to the letter from Bill van Gelder to Dennis Fay and the <br />failure of CMA to recognize the Tri-Valley Transportation fee, which is the only multi- <br />jurisdictional fee that is in place. She was concerned that the priorities of the Valley are <br />not being addressed. <br /> <br /> Mr. Pico suggested rather than a report from him, that a representative of CMA <br />should come to the meeting. <br /> <br /> Ms. Acosta said staff has been trying to schedule that report on an agenda and it <br />gets moved because the agendas have been so crowded. <br /> <br /> Mr. Pico indicated he would miss the CMA meeting this coming Thursday and <br />suggested a staff member be there. <br /> <br />Pleasanton City Council 23 07/20/99 <br /> <br /> <br />
