6. PUBLIC HEARINGS AND OTHER MATTERS <br /> <br />Item 6a <br />Public hearing for 1998-99 Annual Assessments for Landscape and Lightin~ District <br />1984-1 (Ponderosa), 1993-1 CvVindsorh 1993-2 (Bonde Ranch), 1994-1 (Oak Tree <br />Farm), 1995-1 (Moller Ranch) and 1995-2 (Laguna Oaks). (SR99:160) <br /> <br /> Randall Lum presented the staff report. <br /> <br /> Vice Mayor Ayala declared the public hearing open. <br /> <br /> Andy Russo, 441 Mares Court, said the landscape contractor is not providing <br />proper maintenance of the landscape area in Oak Tree Farms. He did not approve of <br />awarding the contract to the lowest bidder. If the lowest bidder is not performing the job, <br />it should be taken off the job. He also had a concem that Phase I was paying for the <br />entire maintenance of Oak Tree Farms. <br /> <br /> Mr. Lum said the City requires every contractor to have a performance bond in <br />order to ensure that the work is properly performed. <br /> <br /> Mr. Fulford indicated that there is a monthly walk through of each of the <br />Landscape and Lighting Districts to ensure that the work is being performed. <br />Occasionally, there is substandard work that needs improvement, which the contractor <br />has an opportunity to remedy before payment is made. In regards to Phase I versus Phase <br />II, currently the parcels in Phase I are being assessed for landscaping maintenance that is <br />in Phase I exclusively. Phase II is still being maintained by the developer and when <br />Phase II is annexed into Phase I, the parcels will be assessed accordingly. He said he <br />would continue to work with Mr. Russo in order to address his concems with the <br />contractor. <br /> <br /> Vice Mayor Ayala asked if a homeowners association could have better control <br /> over which contractor is hired. <br /> <br /> Mr. Lum said it has been explained to each homeowners association the process <br /> through which it could assume the maintenance responsibility itself, instead of having the <br /> City provide the service. The Homeowners Association of Laguna Oaks is pursuing this <br /> altemative. Oak Tree Farms has no Homeowners Association and if the residents in that <br /> Landscaping and Lighting District wanted to pursue the alternative, an association would <br /> have to be formed to assume the responsibility. So far the residents in Oak Tree Farms <br /> have not indicated that they would like to assme that responsibility. <br /> <br /> Ms. Acosta said the maintenance has to be done one way or another, either by the <br /> City, a District or the homeowner association. The City has provided the services <br /> through the Landscaping and Lighting Districts, but if the residents do not like this <br /> method, then other options are available. <br /> <br /> <br />
