It was moved by Mayor Tarver, seconded by Ms. Ayala, adopting Resolution No. <br />99-058, approving a mitigated Negative Declaration for the application of Passport Homes, as <br />fined under Case PUD-98-08 and adopting the Mitigation Monitoring Program for PUD-08- <br />08, Passport Homes 11115 Dublin Canyon Road (Panganiban Property). <br />The roll call vote was as follows: <br />AYES: CouncilmembersAyala, Dennis, Michelotti, and Mayor Tarver. <br />NOES: Councilmember Pico. <br />ABSENT: None. <br />ABSTAIN: None. <br /> <br /> It was moved by Mayor Tarver, seconded by Ms. Ayala, introducing Ordinance No. <br />1781, to be read by title only and waiving further reading thereof, approving the application <br />of Passport Homes for rezoning and PUD development plan approval, as filed under Case <br />PUD-98-08, subject to the conditions listed in Exhibit B with the additional condition that no <br />building permit shall be issued or lot sold for any of the six new homes within this project <br />until after the new elementary school located on Case Avenue is operational but that the <br />applicant could ask for further consideration of the condition based on the progress of the <br />construction of the Case Avenue school. <br /> <br /> Ms. Ayala said she was only supporting the project because the parkland is a part of the <br />project. <br /> <br /> Ms. Michelotti did not want to vote against the project, but she was not completely satisfied <br />with the condition relative to the sale of the lots being tied to the progress of the school's <br />constmction. <br /> <br />The roll call vote was as follows: <br />AYES: Councilmembers Ayala, Dennis, Michelotti, and Mayor Tarver. <br />NOES: Councilmember Pico. <br />ABSENT: None. <br />ABSTAIN: None. <br /> <br /> Ms. Michelotti thought the people supported this project. She said this project is bringing a <br />lot of amenities to the City of Pleasanton. She could not understand why Council could not tie the <br />condition to the issuance of a building permit. She expected to see the completion of the school in <br />the year 2000. She mentioned a promise is a promise, and when Mr. Ford comes back for further <br />consideration she hoped Council would remember that promise. <br /> <br /> Mayor Tarver said the project has been approved and Mr. Ford knows what he needs to do <br />in order to get the development built. <br /> <br />Pleasanton City Council 21 05/18/99 <br />Minutes <br /> <br /> <br />
