Mayor Tarver said his option was no building permit shall be issued or lot would be sold for <br /> any of the six new homes within this project until after new school located on Case Avenue is <br /> operational. Then there could be a proviso that the applicant may request further consideration of <br /> this condition as the school construction progresses. The intent being that the time to occupy the <br /> homes would coincide with the actual opening of the school. <br /> <br /> Mr. Ford understood he could come back in front of the Council with a schedule that <br /> perhaps the School District had given to him that construction is already underway and that the <br /> construction schedule indicates that the school will be complete by the fall of 2000. That would <br /> then allow him to pursue lot sales on the project. <br /> <br /> Mayor Tarver agreed as long as there was nothing interfering with the completion of the <br /> school. <br /> <br /> Ms. Michelotti asked why not write a condition that says no homes could be sold until the <br />school opens, rather then have to come back and ask for further consideration. She said getting an <br />approval on further consideration might not happen. She did not want something to be up in the <br />air, where Passport would say it would not sell any lots until the fall of 2000 and then in November <br />1999 it would be before Council asking for a further consideration. She understood from the <br />testimony that it would take nine months to construct a custom home and twelve months to <br />construct a school once the framing is done. <br /> <br /> Mayor Tarver was not going to support a motion that does anything other than what he has <br />been discussing. <br /> <br /> Ms. Dennis asked if the option could be worded to provide "if the applicant did come back <br />for further consideration such consideration would be based on the progress of elementary school, <br />not on everything." She felt the condition should be linked to the construction of the elementary <br />school. <br /> <br /> Ms. Michelotti understood the condition would be linked specifically to the school site <br />rather than all the other things to be considered. Therefore Passport would keep its word and not <br />sell lots until the school is under construction. <br /> <br /> Ms. Dennis would like the condition to reflect that at the time of further consideration of the <br />timing of the lot sales, it would be based upon the progress of the elementary school construction <br />issues. <br /> <br /> Mayor Tarver wanted the words until a "new elementary school is operational."
