Mr. Ford said Passport Homes would not sell any lots until the Case Avenue school was <br />under construction. <br /> <br /> Ms. Ayala asked if he meant grading of the school site or once the actual building is under <br />construction. <br /> <br /> Mr. Swift said staff could draft such a condition. He felt the Mayor's concem was when <br />the school was actually going to be built. He said it is 99% sure that the school will be built when <br />actual construction is begun pursuant to a contract let for the full work. There will probably be <br />several contracts let in order to fast track the construction. The buildings take the longest time to <br />complete. The time frame for building the buildings takes is about the same amount of time that it <br />takes to build a house. If Council wanted to say, no lot sales or building permits until such time <br />actual construction has begun pursuant to a contract let for the classrooms at the Case Elementary <br />School, "the chances of the houses being completed prior to the school opening would be slim. To <br />really ensure the construction was complete, Council could condition the sale of the lots to two <br />months after construction starts on the school. He said things happen, but he was confident that a <br />linkage to "under construction" solves the issue of the uncertainty that the school will actually <br />open. <br /> <br /> Mayor Tarver said the applicant could come back at any time and present a case that the <br />school is under construction, the contracts are let and it is clearly not an issue. In which case the <br />Council could say sale the lots. <br /> <br /> Ms. Michelotti asked why lots could not be sold, if the City could control when the building <br />permits are pulled. <br /> <br /> Ms. Acosta said it would be difficult if the lots are sold and the City is then dealing with a <br />new individual. The new individual might be upset if the City told the new owner he or she could <br />not pull a building permit. <br /> <br /> Mr. Ford said Passport Homes will accept Option No. 3. <br /> <br /> Ms. Michelotti did not support this option. <br /> <br /> Mr. Ford understood that he could come back through the process and request the ability to <br />sell lots. Once the school is under construction, it would be worthy to come back. <br /> <br /> Ms. Dennis asked if this should be in the conditions.
