The meeting was reconvened at 9:00 p.m. <br /> <br />Item 8b <br />Local Remfiafion of Fn'earms Sales~ Zero Tolerance Policy for Persons Convicted of <br />Possession of l]legal Guns: and Transfer Or Possession of Certain Assault Weapons. <br />(SR 94:280) <br /> <br /> Michael Roush presented the staff report. <br /> <br /> Ms. Dennis asked whether a person could still sell firearms with a home occupancy <br />permit? <br /> <br /> Mr. Roush indicated that some people who have federal licenses also have home <br />occupancy permits. One option could be to change the regulations concerning home occupancy <br />permits to prohibit such activity. <br /> <br /> Ms. Dennis wanted to be sure Pleasanton's regulations coincided with the federal <br />regulations for collectors and for those persons who are in the business of selling firearms. <br /> <br /> Mr. Roush indicated it would not be consistent to allow that use from a home because <br />of the keeping of "stock" and having customers come to the home. <br /> <br /> Ms. Scribner inquired if there was some number of sales that qualified a person as a <br />dealer. She also referred to the Brady Bill requirements before transferring ownership of any <br />firearm. <br /> <br /> Mr. Roush indicated there are state regulations dealing with secondhand goods and <br />pawnshops. The 02 license applies specifical/y to pawnbrokers. He did not believe the local <br />police department is involved with the 01 or 03 license. <br /> <br /> The public hearing was declared open. <br /> <br /> Ed Hagberg, 3686 Touriga Drive, indicated he has a federal license. He explained the <br />documentation required before selling a firearm. It was his belief that many people obtain <br />licenses in order to purchase weapons at a cheaper cost. He stated that if Council modifies the <br />Municipal Code for gun dealers, then it should also apply the same regulations to other dealers <br />from the home, such as Avon and Shakley. He strongly urged Council not to take action at this <br />time. <br /> <br /> Colleen Seal, 3660 Caneill Court, speaking on behalf of her father Michael Seal, 496 <br />Adams Way, was opposed to the proposed ordinance. There are many fine people involved in <br />gun collecting and shooting and she does not see a problem in or a threat to the citizens of <br />Pleasanton.
