Ms. Scribner did not believe there was a problem with gun dealers in the home as long <br />as they are licensed and follow state and federal laws. She alto supported the zero tolerance <br />policy for illegal gun possession and legislation prohibiting assault weapons. <br /> <br /> Ms. Mohr indicated the key issue to her was compliance with home occupation <br />regulations, which means a person is not selling goods and customers do not come to the home. <br />With regard to zero tolerance, there are not enough resources to build enough jails to <br />accommodate those prosecuted under this policy. She did believe that the issue of assault <br />weapons needs to be addressed and a practical way of defining assault weapons needs to be <br />found. These are not hunting or sport weapons and such weapons need to be kept off the street. <br /> <br /> Mr. Pico supported the zero tolerance policy and federal legislation restricting assault <br />weapons. He believed the issue of regulating where firms dealers may operate needs more <br />debate. He referred to regulations for adult entertainment stores being a certain distance from <br />schools and expressed concern that an authorized gun dealer is fairly dose to one of the <br />elementary schools. Changes in attitudes and laws at higher levels must start at the local level. <br /> <br /> Ms. Dennis requested staff to compare home occupancy rules and federal regulations on <br />firearrns dealers to ensure that they are consistent. It is her understanding that Type 3 licenses <br />are for collectors and Type 1 licenses are for wholesalers who sell to the public. She suggested <br />that Type 1 licenseholders could cooperate and sell from one location in a commercial area. <br />Ms. Dennis requested that the information regarding federa/regulations be discussed again under <br />"Matters Initiated" and at the same time get information on All 3410. <br /> <br /> Mr. Roush indicated staff needs time to follow the progress of pending federal <br />legislation, which may preempt local regulation. At that time, an analysis of such legislation <br />and its effect on home occupancy permits can be brought back to Council. <br /> <br /> It was moved by Mr. Tarver, seconded by Mr. Pico, to support Supervisor Perata's <br />resolution for zero tolerance for those who possess firearms illegally and that it be forwarded <br />to the League of California Cities for the October conference. <br />The roll call vote was as follows: <br />AYES: Councilmembers - Dennis, Pico, Scribner, and Mayor Tarver <br />NOES: Councilmember Mohr <br />ABSENT: None <br />ABSTAIN: None <br /> <br />08/16/94 <br /> -11- <br /> <br /> <br />
