Zoning for the property is PUD (Planned Unit Development) - Low Density <br />Residential District (SR94:217) <br /> <br /> Mr. Swift presented the staff report. <br /> <br /> Mr. Tarver declared the public hearing open on the application. <br /> <br /> Peter Shutts, 4133 Mohr Avenue #G, representing Mr. Thomas, agreed with the staff <br />recommendations, but requested that Condition No. 6 be removed. This would bring the <br />conditions applicable to this property in line with conditions applicable to other parcels in the <br /> <br /> Jerrell Thomas, 27933 Via Ventana, Los Altos Hills, clarified that in his letter of June <br />11, 1994 he referred to the negotiations that he and Mr. Ricci were working on at that time. <br />His letter stated that Mr. Ricci had received $30,000 credit from Ms. Ku on his purchase of her <br />property. That was an error. Mr. Ricci received $18,000. Mr. Thomas apologized to Mr. <br />Ricci for the inaccuracy. <br /> <br /> There being no further testimony, Mr. Tarver declared the public heating closed. <br /> <br /> Ms. Mohr commended the two neighbors for reaching an agreement. <br /> <br /> It was moved by Ms. Mohr, and seconded by Ms. Scribner, that Ordinance No. 1629 <br /> be introduced, to be read by title only and waiving further reading thereof, approving the <br /> application of Peter Shutts for a major modification to an approved PUD Development Plan as <br /> fled under Case PUD-91-19-1M, but deleting Condition No. 6. <br /> <br /> Mayor Tarver believed that this type of approval should be consistent with all approvals <br /> in the area and therefore, he disagreed that Condition 6 should be deleted. <br /> <br />07/05/94 4 <br /> <br /> <br />
